Paul Bunyan Professional license agreement

This agreement is between you and IT Business Consulting, Inc. (“Diamond Sierra”). By installing or using Paul Bunyan Professional (“the Software”) you accept it. If you do not accept it, do not install the Software.

1. License

With a paid, current plan, Diamond Sierra grants you a non-exclusive, non-transferable license to install and use the Software on the number of live websites in your plan, for your own organization or for the clients you build and maintain sites for. Staging, development and local copies of a licensed site may also use it and do not count as sites. The license is activated with the key issued for your order.

2. What You May Not Do

You may not:

• use the Software on more live sites than your plan allows
• copy, share, sell, rent, sublicense or redistribute the Software or your license key, free or paid, or bundle it in a theme, plugin, hosting plan or product of your own
• remove, change or get around the license check, or help anyone to
• reuse its code in other software

You may change the Software for your own sites, but changed copies are not supported.

3. The Free Plugin

The Software is an add-on to the free Paul Bunyan plugin, which is licensed separately under the GNU General Public License. This agreement covers only the Software.

4. License Checks

The Software checks its key with diamondsierra.com once a day and when it looks for updates. It sends the key, the site address and its version, and nothing from your logs. If the key is canceled (for example after a refund, chargeback or canceled order), or the site is removed from the key, the Software switches itself off at its next check. If your plan ends without renewal, the Software keeps working on the sites it is activated on, without updates or support.

5. Term And Termination

This license lasts while you comply with it. It ends automatically if you break section 2, or when your key is canceled. When it ends, you must stop using the Software and delete it.

6. No Warranty

THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Test it on your site and keep backups.

7. Limit Of Liability

TO THE EXTENT THE LAW ALLOWS, DIAMOND SIERRA IS NOT LIABLE FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOST PROFITS OR LOST DATA. ITS TOTAL LIABILITY IS LIMITED TO WHAT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS BEFORE THE CLAIM.

8. Terms Of Sale

Prices, renewals, cancellation and refunds are covered by the Terms of Sale at diamondsierra.com/terms.

9. Law

This agreement is governed by the laws of the State of Florida. Disputes are heard in the state or federal courts for Hillsborough County, Florida.
